3. Payments

Any deposit requested is used to secure the booking and cover administrative or preparatory costs, and it may be non-refundable except where required by law or expressly stated otherwise.

Prices may be quoted as fixed fees, hourly rates, or estimated ranges. Estimates are not guarantees unless clearly described as fixed. Where the work takes longer than expected because of conditions beyond reasonable control, the final charge may reflect the actual time spent or the extra labour required, provided this is fair and communicated where practical. If access is denied, the customer is absent when attendance is required, or the property is not ready for the agreed work, the appointment may be treated as a late cancellation or a wasted visit. 5. Liability and Limitations

The business is not responsible for pre-existing damage, poor root structure, disease, decay, unstable fencing, cracked paving, hidden pipework, or deterioration that becomes visible during ordinary work. In particular, pruning, cutting, lifting, and clearance may reveal underlying conditions that were not apparent before the service began.

The business will not be liable for loss or damage arising from inaccurate information supplied by the customer, insufficient access, failure to warn of hazards, or instructions that the business reasonably considers unsuitable. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under UK law. Subject to that, the business’s liability for any claim arising from a service will be limited to the amount paid for the specific service giving rise to the claim, except where a higher limit is required by law.

Such materials may not be accepted under a standard gardening service and may require specialist disposal arrangements. 7. Materials, Plants, and Equipment

If the service includes the supply of plants, compost, mulch, turf, or other materials, the business will use reasonable care in sourcing items that are fit for the intended purpose. However, natural products can vary in colour, growth rate, performance, and seasonal appearance. Any advice given about plant suitability, maintenance, or expected results is provided in good faith but is not a guarantee of future growth or success.

Where the customer supplies materials or equipment, the business is not responsible for faults, hidden defects, or poor quality unless those faults should reasonably have been obvious before use. Gardeners Feltham may refuse to use unsuitable customer-supplied materials where they could create a safety risk or lead to unsatisfactory results. Any borrowed or customer-owned equipment used at the customer’s request remains the customer’s responsibility unless damage is caused by proven negligence.

8. Complaints and Remedies

If the customer believes the service has not been performed in accordance with these terms, the issue should be raised promptly and in a reasonable manner so that it can be reviewed. 9. Data, Privacy, and Communications

If any part of these terms is found to be unlawful, invalid, or unenforceable, that part will be treated as removed to the minimum extent necessary, and the remaining provisions will continue in full force. No failure or delay by Gardeners Feltham in enforcing a right or remedy will operate as a waiver of that right or remedy.
